RackSavant Full Terms and Conditions

Welcome to RackSavant.com! These Terms and Conditions ("Terms") govern your use of the RackSavant platform and services. By accessing or using www.racksavant.com (the "Site"), you agree to be bound by these Terms. Please read them carefully.

These Terms are a binding agreement between you and RackSavant LLC ("RackSavant," "we," "our," or "us"). By using our platform, including any related services, content, mobile applications, and features, you agree to these Terms.

• "Service": Products, services, tools, and features provided through the RackSavant ecosystem.
   
• "User": Anyone who accesses or interacts with the Site.
   
• "RackSavanteur": A user who has paid to participate in our consignment model and is eligible for commissions.
   
• "NFT": A non-fungible token, used for digital authentication of certain physical goods.
   
• "Content": All media, product information, and interactions generated by or on behalf of users and RackSavant.
   
• "Approved Items": Items submitted and accepted by RackSavant for resale or upcycling.
   

You must be at least 18 years old to use our services. You agree not to engage in unlawful, abusive, or harmful activity, and must keep your login credentials secure.

Users are responsible for providing accurate information, securing their accounts, and ensuring that any uploaded content is original and lawful.

All content, branding, and features are owned by RackSavant unless otherwise noted. By submitting content, you grant us a royalty-free, worldwide license to use, display, and distribute it for promotional or operational purposes.

• A $30 RackSack Fee applies to become a RackSavanteur and receive a consignment shipping kit.
   
• RackSavanteurs earn 50% commission on the net sale price of each approved item.
   
• Restocking Fee: 25% of the reservation price if you choose to withdraw a listed item.
   
• Optional Storage Extension Fee: $30 for an additional 6 months beyond the original storage period.
   
• A $30 credit may be issued upon completion of a customer feedback survey.
   
• Membership Tiers (optional): Offer added benefits such as styling priority, early auction access, waived restocking fees, and exclusive content.
   
• AI-Powered Styling & Upcycling: Users may pay to preview AI-generated transformations and submit upcycling requests.
   
• Podcast Promotions: Users may opt-in to a premium feature that enables them to record or host podcast-style features to promote their items.
   

Upon payment, you will receive a RackSack (18 x 12 x 8", 32 ECT). You are responsible for packing and shipping approved items. In-person drop-offs may be arranged under special circumstances. Items not approved will not be listed, and there is no guarantee all items submitted will be accepted.

Items are stored for 6 months. Unclaimed items post-term will be returned at your cost unless a $30 extension is paid. A customer survey credit may be applied to this return fee.

RackSavant will process, style, and list accepted items. Reservation prices are binding. You may withdraw unsold items prior to sale for a 25% restocking fee.

"Upcycle Eligible" items may be customized based on buyer interest. Once labeled for upcycling, the item cannot be withdrawn. Users may interact with AI-generated previews or propose transformations at a premium tier.

Select items are authenticated with NFTs from the GitLit Collection (via OpenSea), serving as certificates of origin, history, and resale traceability.

• If separated from the physical item, the NFT loses its RackSavant authenticity.
   
• NFT holders are entitled to ongoing royalty compensation upon resale of the item.
   
• NFT-paired items may grant access to exclusive drops, community benefits, or digital wardrobes.
   

RackSavant offers a podcasting feature that allows users to record short audio clips or interviews promoting their items or style stories. This content may be showcased across RackSavant platforms and shared by buyers to enhance narrative and visibility.

We reserve the right to suspend or terminate accounts in violation of these Terms. Users may request account deletion by contacting us.

All services are provided "as-is." RackSavant is not responsible for indirect or consequential damages. We disclaim warranties to the fullest extent permitted by law.

You agree to indemnify and hold RackSavant harmless from claims related to your use of the platform, including violations of these Terms or applicable laws.

We may update these Terms periodically. Updates will be reflected on this page, and continued use constitutes acceptance.

These Terms are governed by California law. Any disputes shall be resolved in the courts located in San Francisco, CA.

These Terms form the entire agreement between the user and RackSavant. If any part is deemed invalid, the remaining terms remain enforceable.

Return and Refund Policy

All sales are final.
Refunds are only available in cases of proven damage or major fulfillment error. Requests must be submitted with documentation to consign@racksavant.com.
